General Terms and Conditions

1. Formation of the contract

Our online shop is exclusively intended for consumers from EU member states. The presentation of our products in our online shop is simply a non-binding invitation to you to order these products from us. By placing an order, you are submitting a binding offer to us to enter into a contract with you. By delivering the goods ordered, we are accepting this offer.

You will first receive an e-mail confirming receipt of your order at the e-mail address you have indicated (order confirmation). This order confirmation simply documents receipt and does not indicate the offer has been accepted. We may accept or reject orders as we see fit. If we do not accept an order, we will let you know immediately.

If we realise when processing your order that it is not possible to deliver the products you have ordered, we will notify you immediately. No contract will be concluded for the products that cannot be supplied.

The order process using our online shop consists of several steps. The first step is to select the products you require. The second step is to provide your customer details, including the invoicing address and the delivery address if this is different. The third step is to choose your method of payment. In the final step, you have the opportunity to check all the details (e.g. name, address, payment method, items ordered) and make any corrections required before you submit your order to us by clicking the submit order button.

2. Cancellation right

The following cancellation right applies to consumers only.

You are entitled to cancel this contract within fourteen days without stating your reasons.

The cancellation (cooling-off) period for a purchase agreement is fourteen days from the date on which you or a third party appointed by you, other than the carrier, took possession of the final item.

To exercise your cancellation right, you must provide a clear declaration (e.g. a letter sent by post, a fax or an

You may, but are not obliged to, use the sample cancellation form provided in our online shop for this purpose.

To comply with the cancellation period, it is sufficient for you to send the notification that you are exercising your cancellation right before this period expires.

Consequences of cancellation: If you cancel this contract, we must reimburse all payments we have received from you, including delivery costs (except additional costs resulting from a request by you for a different type of delivery to the most economical standard delivery option offered by us). We must do so promptly, within fourteen days of the date on which we receive notification that you are cancelling this contract. Unless some alternative arrangement has been expressly agreed with you, the method of payment we use for this reimbursement will be the same as the one used by you for the original transaction; under no circumstances will you be charged for this reimbursement.

We can refuse to reimburse payments until we have received the returned goods or you have provided proof that you have returned the goods, whichever happens first.

To comply with this deadline, it is sufficient to dispatch the goods before the fourteen-day period expires.

You must pay the direct costs of returning the goods.

You will only be required to pay for any loss in the value of goods if this is the result of activities that were not necessary for you to check their condition, properties and operation.

3. Prices

Prices shall be as indicated in our online shop on the day the order is placed. All prices include VAT at the statutory rate. Delivery charges are extra.

4. Minimum order value

The minimum value for any order is €25.00 (twenty-five euros).

5. Delivery charges

The delivery charges per order are as follows:

Belgium, Czech Republic, Denmark, Luxembourg, Netherlands: € 21,42

Austria, Finland, France, Italy, Sweden: € 33,20

Greece, Ireland, Portugal, Spain: € 44,86

Croatia, Poland, Slovakia, Slovenia: € 30,23

Bulgaria, Estonia, Hungary, Latvia, Lithuania, Romania: € 40,10

Cyprus, Malta: On request

The delivery charges already include VAT at the statutory rate.

6. Delivery Date

The products you order will be shipped 1 to 4 working days after the order is received or, in the case of payment in advance, 1 to 4 working days after payment is received.

Should it not be possible, through your own fault, to deliver the goods despite three attempts being made, we shall be entitled to withdraw from the contract. Any payments made will be returned to you immediately.

7. Transport damage

If goods are delivered with obvious transport damage, please submit an immediate complaint to the delivery agency and contact us as soon as possible (tel. + 49 (0)2191 890 254 0, e-mail: info@uwkinetics.eu).

If you fail to submit a complaint or get in touch, this will have no consequences whatsoever on your statutory rights of warranty, but you will be helping us to assert our own claims against the carrier and/or transport insurer.

8. Terms of payment

Payment may be made in advance (by prior transfer) or by direct debit, Visa or MasterCard. We reserve the right not to accept specific types of payment. If you elect to pay in advance, we will provide you with the relevant bank details in the confirmation of order. The invoice amount is to be transferred to our account within 10 days. If you elect to pay by direct debit, Visa or MasterCard, your account will be debited on receipt of your order.

9. Reservation of ownership

The goods supplied shall remain our property until all amounts due have been paid in full. No pledging, transfer by way of security, processing or transformation shall be permitted without our consent prior to the transfer of ownership.

10. Statutory warranty

The items on offer in our shop are subject to the statutory rights of warranty.

11. Copyright protection

We reserve all proprietary rights and copyrights in all illustrations, photos, graphics, drawings and other documentation etc. These may only be made accessible to third parties on obtaining our written consent.

12. Online dispute resolution

Pursuant to Article 14 (1) of Regulation (EU) No 524/2013 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on consumer ODR), we hereby make reference to the existence of a platform for online dispute resolution. 13. Applicable law

German law shall apply exclusively.

14. Final provisions

Should any provision in these General Terms and Conditions be invalid, this shall not invalidate the rest of the contract. The relevant statutory regulations shall replace the invalid provision.
